Hereinafter referred to as “Octopus Concept Club”, “Big Wave Experience”, “Nazaré Challenge”, or “Freddy Olander”, depending on the context of the service.
1. Scope and Applicability
These General Terms and Conditions (“GTC”) apply to all services, activities, programs, and events provided under the brands Big Wave Experience / Nazaré Challenge, Octopus Concept Club, and Freddy Olander.
They govern participation in surf coaching, workshops, speaking engagements, retreats, wellness programs, memberships, and all related services operated by Development Projects by CCDASM, Unipessoal LDA (“the Organizer”).
By booking, registering, or participating in any of the Organizer’s offerings, the participant (“Client”) agrees to these terms.
2. Registration and Confirmation
Registration must be made in writing (via email, website booking form, or signed document).
A booking becomes binding once confirmed in writing by the Organizer.
The Organizer reserves the right to decline participation at its discretion.
3. Conditions of Participation
Participation in all activities is at the participant’s own risk.
The participant confirms that there are no medical restrictions preventing participation in any sporting, physical, or wellness activity.
The minimum age for participation is 18 years. Exceptions may be made with written consent from a legal guardian.
The participant must follow the Organizer’s safety instructions and act responsibly during all activities.
4. Services Provided
The scope of services corresponds to the details provided in the written booking confirmation.
Minor modifications to the program or services may occur due to weather, safety conditions, or organizational reasons, provided these changes do not significantly alter the overall experience.
5. Participant’s Own Responsibility and Assumption of Risk
The participant understands and acknowledges that certain activities, especially big wave surfing, ocean-based training, cold exposure, breathwork, and physical exercise, involve inherent risks, including serious injury or death.
By participating, the client:
Accepts full personal responsibility for their health, safety, and belongings.
Releases the Organizer from any liability for injuries, accidents, or damages, except in cases of gross negligence or intent.
Agrees to use all facilities and equipment properly and responsibly.
Participants are advised to hold personal accident and health insurance that covers sports and adventure activities.
6. Membership and Club Access (Octopus Concept Club)
Members and day visitors use all facilities (e.g., sauna, ice bath, jacuzzi, fitness area, lounge) at their own risk.
Each member is responsible for maintaining cleanliness, hygiene, and respectful use of all areas.
The Organizer is not liable for accidents, injuries, or loss of personal belongings within the club premises, except in cases of gross negligence or intent.
Memberships are personal and non-transferable. The Organizer reserves the right to revoke access in cases of misconduct or non-compliance with house rules.
7. Cancellation by the Participant
Cancellations must be made in writing.
The following fees apply based on the total booking price:
Up to 60 days before the start: €50 administrative fee
59 to 30 days before: 25% of total amount
29 to 15 days before: 50% of total amount
14 to 7 days before: 75% of total amount
Less than 7 days before: 100% of total amount
Participants may provide a suitable replacement person (minimum age 18) for a transfer fee of €25.
Travel cancellation insurance is recommended.
8. Cancellation or Changes by the Organizer
The Organizer reserves the right to cancel or modify any activity or program in the following cases:
a) Insufficient number of participants (minimum: 3 persons per activity, unless privately booked).
b) Force majeure or safety concerns (e.g., extreme weather, natural disasters, health risks).
c) Participant misconduct, including persistent disturbance or failure to follow safety instructions.
If cancellation occurs before the start of the event, participants will receive a refund of payments made.
If cancellation occurs after the start, refunds are at the Organizer’s discretion.
9. Liability and Limitation of Liability
The Organizer’s liability is limited to three times the booking price for any contractual claims unless the damage was caused intentionally or by gross negligence.
The Organizer is not liable for:
Injuries, accidents, or health issues arising from participation.
Loss, theft, or damage to personal items.
Services provided by third-party partners or external providers.
All activities are entered into voluntarily, with full acknowledgment of the risks involved.
10. Changes in Program or Schedule
The Organizer reserves the right to adjust activities, itineraries, or schedules due to safety, weather, or organizational requirements.
Such changes do not justify a refund claim, provided a reasonable alternative is offered.
11. Warranty and Complaints
If a service defect occurs, the participant must report it immediately to the Organizer on-site.
The Organizer will aim to correct the issue or provide an equivalent replacement service.
Claims not reported during the stay cannot be accepted retroactively.
12. Image Rights and Media Usage
Participants consent to being photographed or filmed during events, sessions, or activities.
These materials may be used by the Organizer for marketing, social media, and promotional purposes without further compensation.
Participants may withdraw this consent in writing before the event or activity begins.
13. Data Protection and Privacy
The Organizer processes personal data in accordance with applicable data protection laws.
Data may be used for internal administration, communication, and marketing purposes.
Participants may revoke consent for data processing or marketing use at any time by written notice.
All collected data will be treated confidentially and will not be shared with unauthorized third parties.
14. Exclusion of Claims / Statute of Limitations
Claims arising from defective services or non-performance must be submitted in writing within one month after the end of the activity.
Claims expire one year after the contractual end date of the service.
15. Jurisdiction and Applicable Law
These Terms are governed exclusively by the laws of the Portuguese Republic.
The place of jurisdiction for all disputes is Nazaré, Portugal.
16. Severability Clause
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid provision shall be replaced with one that most closely reflects its original purpose and intent.

BIG WAVE EXPERIENCE
TERMS & CONDITIONS & WAIVER OF LIABILITY
Event Organizer: Big Wave Experience (“Organizer”)
Location: Nazaré, Portugal
Effective Date: 02.10.2025
By booking or participating in any activity organized by Big Wave Experience (“Activity”), Participants acknowledge and accept the terms of this Agreement in full.
1. SCOPE & ACKNOWLEDGEMENT
1.1. This Agreement applies to all Participants engaged in any Activity provided by the Organizer, including but not limited to:
Tow-in surfing support
Jet ski transport, support, and rescue
Safety oversight in the ocean and harbor
Observation of big waves from land or sea
Training sessions, briefings, or workshops linked to the Experience
1.2. By signing or participating, Participants confirm that they have read, understood, and accepted all terms and risks outlined herein.
2. DESCRIPTION OF RISKS
Participants acknowledge that activities around Nazaré’s big waves involve inherent and extreme risks, including but not limited to:
Large swells, rogue waves, and unpredictable ocean conditions
Strong currents, rip tides, and rapidly changing weather
High-speed jet ski transport and tow-in operations
Equipment malfunction, collision, or impact with watercraft or floating debris
Slips, falls, drowning, serious injury, permanent disability, or death
3. PERSONAL RESPONSIBILITY & ASSUMPTION OF RISK
Participants confirm and agree that:
They are solely responsible for their safety and decisions (whether to enter the water, board a jet ski, attempt a wave, or return to shore).
They are physically and mentally fit, capable swimmers, and not under the influence of alcohol, drugs, or impairing substances.
They have appropriate accident, medical, or travel insurance covering high-risk water sports. If not, they accept full risk of participating without such coverage.
They voluntarily assume all risks, known and unknown, associated with the Activity.
4. RELEASE OF LIABILITY
To the maximum extent permitted by law, Participants release, waive, and agree not to sue the Organizer, its staff, partners, sponsors, volunteers, or representatives (“Released Parties”) for any claim, injury, damage, or expense arising from participation, including but not limited to:
Personal injury, illness, disability, or death
Property loss or damage (e.g., surfboards, phones, cameras, equipment)
Negligence or errors by the Organizer or third parties
This release applies regardless of cause, including negligence or gross negligence, as far as permitted under Portuguese law.
5. SAFETY & CONDUCT
Participants agree to:
Follow all instructions given by the Organizer without exception.
Wear required safety equipment (e.g., life jackets, impact vests, helmets, leashes).
Refrain from reckless actions that endanger themselves or others.
Accept removal from the Activity without refund if they fail to comply with safety rules.
6. BOOKING, PAYMENT & CANCELLATION
6.1. Booking & Payment: Confirmed only upon full payment unless otherwise agreed.
6.2. Participant Cancellation:
14 days before Activity: full refund (minus transaction fees).
7–14 days before: 50% refund.
<7 days before: no refund.
6.3. Organizer Cancellation: The Organizer may cancel/reschedule due to weather, tides, safety, or unforeseen circumstances. Participants may choose between rescheduling or a full refund.
7. MEDIA CONSENT (AUTOMATIC)
By participating, Participants automatically grant the Organizer:
Perpetual, worldwide, royalty-free rights to capture, use, and distribute photographs, video, and audio recordings taken during the Activity.
Permission to use such media for promotional, commercial, and educational purposes in any format (digital, print, broadcast, social media) without notice, approval, or compensation.
Waiver of any rights to inspect or restrict media use.
8. GOVERNING LAW & JURISDICTION
This Agreement is governed by Portuguese law. Any disputes shall be resolved exclusively in the competent courts of Portugal.
9. SEVERABILITY
If any provision is deemed invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
Nazare Challenge
Terms and Conditions for Qualification to Final Big Wave Surfing Paddle-In Competition
1. Acceptance of Terms and Conditions
By submitting your digital qualification entry for the final Big Wave Surfing Paddle-In Competition (the “Event”) at Nazaré, Portugal (the “Location”), you agree to these Terms and Conditions, which govern your participation in the qualification process and the Event itself.
2. Digital Submission and Qualification Process
- The qualification process is conducted through digital submission of video footage demonstrating your ability to paddle-in and surf big waves.
 - Submitted videos will be reviewed by an appointed panel, and surfers will be selected based on their performance as judged by the panel.
 - Submission of videos does not guarantee qualification for the final Event.
 
3. No Liability for Participation in Qualification
- The qualification process requires surfers to surf large, powerful waves, often in unpredictable conditions. By participating, you acknowledge that surfing big waves, particularly at spots such as Nazaré, is an inherently dangerous activity that can result in serious injury or death.
 - The Event organizers do not provide any form of supervision, training, or safety measures during the digital qualification process. It is the sole responsibility of the surfers to ensure their own safety while attempting to qualify.
 - All participants are solely responsible for their personal safety, including the use of appropriate gear, safety measures, and obtaining local knowledge about the conditions at the surf spots they choose.
 
4. Assumption of Risk
- By submitting your digital entry, you acknowledge and agree that:
- You are voluntarily participating in the qualification process and are aware of the risks involved.
 - You are fully responsible for your actions and decisions regarding your participation, and you voluntarily assume all risks associated with surfing large waves, including but not limited to physical injury, mental distress, or death.
 
 
5. Waiver of Liability
- The Event organizers, sponsors, partners, and affiliates are not liable for any injury, loss, or damage arising out of your participation in the qualification process, including your attempts to surf big waves to create video submissions.
 - You agree to release and hold harmless the Event organizers from any claims, liabilities, or damages that may arise as a result of your participation in the qualification process or the final Event.
 
6. Responsibility for Medical Insurance and Health
- Surfers are responsible for maintaining their own personal health insurance coverage. The Event organizers do not provide any form of medical insurance or coverage for participants in the qualification process or the final Event.
 - In the event of injury, illness, or accident, the participant is solely responsible for all associated medical costs.
 
7. Acknowledgment of Dangerous Conditions
- Nazaré, Portugal, is known for producing some of the largest and most dangerous waves in the world. The conditions at Nazaré are unpredictable and potentially life-threatening.
 - Surfers must use their judgment in evaluating whether they are physically capable of participating safely in such conditions. The organizers take no responsibility for any harm that may occur before, during, or after the qualification process or the final Event.
 
8. Rights to Submitted Content
- By submitting video footage as part of the qualification process, you grant the Event organizers the right to use your submission for promotional purposes, including but not limited to online promotion, television broadcasts, and social media channels.
 - You confirm that all content submitted is original and that you have the rights to grant such permission for its use.
 
9. Participation in the Final Event
- If qualified, participants must make their own travel and accommodation arrangements to attend the final Event at Nazaré, Portugal.
 - The Event organizers will provide details of the final Event but will not be responsible for any personal arrangements, logistics, or expenses incurred by the participants.
 - Participation in the final Event is conditional upon agreeing to further terms and conditions specific to the Event, including rules around safety and conduct at the competition.
 
10. Governing Law and Dispute Resolution
- These Terms and Conditions are governed by the laws of Portugal. Any disputes arising out of these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of Portugal.
 
By submitting a video for qualification, you confirm that you have read, understood, and agreed to these Terms and Conditions.
Octopus Concept Club – Terms & Conditions
Effective Date: 01.10.2025
1. Scope & Agreement
These Terms & Conditions (“T&Cs”) apply between you (“Member”, “Guest”, “User”) and Octopus Concept Club (“Club”, “we”, “us”), located in Nazaré Harbor, Portugal.
By purchasing a pass, membership, or booking any service, you agree to these T&Cs.
2. Purpose & Nature of the Club
The Octopus Concept Club is a private shared workspace and creative community designed for professionals, entrepreneurs, and creators.
Our focus is to provide inspiring workspaces, community-driven networking, wellness, and recreational facilities — not to operate as a public spa, gym, or restaurant.
3. Membership & Access
The Club is open 7 days a week, from 7:00 AM to 7:00 PM (closed up to 2 days per month for maintenance).
Access is limited to registered members and approved guests only.
A maximum of 20 members may use the Club at any time.
All visits must be booked in advance via the Club’s booking calendar.
Members must check in and out during their booked time slots.
4. Services & Facilities
Included in general access:
High-speed internet & dedicated work areas
Complimentary drinks (coffee, tea, water, juices)
Changing snacks
Self-service kitchen, BBQ & cooking area
Fitness corner and relaxing zones with fireplaces
Sunset terrace & lounge areas
Projector, whiteboard & DJ setup (upon booking)
Optional paid add-ons (available for members only):
Wellness Zone: Sauna, Jacuzzi, Ice Bath (available through separate booking & fee)
All facilities are for private member use only and must be booked in advance when required.
5. Booking & Use of Facilities
Certain areas (e.g. sauna, jacuzzi, ice bath, BBQ, projector, DJ setup) require prior booking via the online system.
Bookings operate on a first-come, first-served basis.
Members must respect time limits and leave all spaces clean and organized.
Repeated misuse or failure to respect bookings may lead to suspension.
6. Conduct & Community Rules
Treat all members, staff, and neighbors with respect.
Keep noise levels appropriate for a coworking and community space.
Illegal substances, harassment, or aggressive behavior are strictly prohibited.
Guests must be registered in advance and remain under the responsibility of the inviting member.
Damage caused by negligence will be charged to the responsible member.
7. Liability & Safety
Use of all facilities (including fitness and wellness equipment) is at your own risk.
The Club is not liable for theft, loss, or damage to personal belongings.
The Club is not responsible for injuries or health issues arising from facility use (e.g. sauna, ice bath).
Members are responsible for assessing their own health condition and should consult medical advice before using wellness facilities.
8. Membership & Payments
Pass options:
Day Pass – €59
Week Pass – €230
Monthly Membership – €490
Yearly Membership – €5,300
All fees must be paid in advance and are non-refundable, except as required by EU consumer protection law.
Memberships are personal and non-transferable.
Access may be suspended for missed or late payments.
9. Cancellations & Termination
Day/Week passes: cancellation possible up to 24h before booked time.
Monthly memberships: 30-day notice required before month-end.
No refunds for unused services or no-shows.
The Club reserves the right to terminate memberships for repeated rule violations.
10. Events & Community Activities
The Club may organize social, networking, or wellness events for members.
Participation is voluntary and may include additional fees.
Events are private and restricted to members and approved guests.
11. Data Protection & Privacy
All personal data is processed according to the EU General Data Protection Regulation (GDPR / RGPD).

12. Intellectual Property
All branding, photos, texts, videos, and design concepts are the exclusive property of Octopus Concept Club.
No material may be used or reproduced without written permission.
13. Noise & Neighborhood Rules
Music (DJ setup, events, BBQ) must respect local noise laws and community rules.
Quiet hours apply as required by Portuguese law.
Failure to comply may lead to access restrictions or penalties.
14. Amendments
We reserve the right to update these T&Cs, membership prices, or services at any time.
Members will be informed of significant changes in advance.
15. Governing Law & Jurisdiction
These Terms & Conditions are governed by Portuguese law.
Any disputes shall be settled in the courts of Leiria District, Portugal.
